Ben J. Himmelstein

Ben Himmelstein is a business lawyer with focus on business disputes and transactions. His practice includes business dissolutions, misappropriation of trade secrets, business torts, sales contracts, buy and sell agreements, and non-compete and non-solicit agreements, as well as all types of business litigation and formation, including civil matters involving contract disputes and intentional torts, as well as the governance of limited liability companies and corporations. He represents a variety of businesses throughout Arizona in a range of industries, primarily focused in technology, medical and dental. As the former Chairman of the Board of the Arizona Small Business Association, Ben is passionate about the growth of Arizona’s business community.

Ben volunteers his time as a Fee Arbitrator for the State Bar of Arizona, arbitrating disputes between clients and their attorneys regarding attorneys’ fees, and as a Judge Pro Tempore for Maricopa County Superior Court, where he conducts Settlement Conferences for parties involved in active litigation. Ben is frequently hired as an arbitrator for the American Arbitration Association.

Since 2004, Ben has successfully helped his clients navigate a wide range of disputes involving business issues. His dedication to the successful solution of his clients’ legal issues has resulted in numerous awards received over the course of his practice, including the AV Preeminent rating from Martindale Hubbell. He was named one of the Southwest’s Rising Stars by Super Lawyers from 2011-2018, is listed as one of Arizona’s Finest Lawyers, as well as one of the Nation’s Top One percent by the National Association of Distinguished Counsel. Recently, the Expert Network recognized Ben as one of the top lawyers in the industry. He has been recognized as one of Arizona’s Business Leaders for the last two years. And, AZ Big Media listed Ben as one of the Top 100 Lawyers in Arizona for 2020.

His previous experience includes working as the Chief Operating Officer and Chief Financial Officer for a boutique law firm in Phoenix. He is a founding member of the Arizona Jewish Lawyers Association and served on the Board of the New Foundation. Ben is currently active in Phoenix Rotary 100 and was recently appointed to the Jewish Federation of Greater Phoenix’s Cardozo Society.

Ben Himmelstein is a partner at Himmelstein & Adkins, LLC. Ben graduated from the Sandra Day O’Connor School of Law with an additional certificate in Law, Science and Technology. He received an undergraduate degree in psychology from Arizona State University. He is licensed to practice before all Arizona State courts, the U.S. District Court for the District of Arizona, and the U.S. Circuit Court of Appeals for the Ninth Circuit.  

In his free time, Ben likes to spend time with his family and enjoys traveling.
